Government Hasn’t Proven Trump Held Classified Records: Trump Lawyers

U.S. officials have not proven that former President Donald Trump held classified records, lawyers for the ex-president said in a new filing on Sept. 20.

The government “presupposes that the documents it claims are classified are, in fact, classified and their segregation is inviolable. However, the Government has not yet proven this critical fact,” the lawyers wrote to the U.S. Circuit Court of Appeals for the 11th Circuit.

They pointed to an executive order from former President Barack Obama, which remained in place through the Trump presidency and gives the president authority to declassify any document, and said Trump had the absolute authority to declassify any records.

Materials marked classified were found at Trump’s Mar-a-Lago home by FBI agents executing a search warrant in August, and the government has repeatedly described them as classified records.

“The district court has entered an unprecedented order enjoining the Executive Branch’s use of its own highly classified records in a criminal investigation with direct implications for national security,” U.S. lawyers said in a recent motion to the Circuit Court.

Request for Partial Stay

The lawyers were asking for a partial stay of an order entered by U.S. District Judge Aileen Cannon, a Trump appointee who appointed a special master to review the seized records and ordered the government to halt using the seized records for anything apart from a national security review.

The Department of Justice asked the court to allow it to continue using the records for a criminal investigation into Trump.

Its argument in part hinged on whether Trump has standing to claim legitimate access to materials marked classified. U.S. lawyers said he did not “because those records are government property, over which the Executive Branch has exclusive control and in which Plaintiff has no property interest.” Executive privilege claims cannot work because Trump is no longer president, they added.

“Even if a former President could assert executive privilege against the Executive Branch’s review and use of its own documents, any such assertion would inevitably fail as to the records bearing classification markings,” they also said.

They also argued that letting the special master and Trump’s lawyers review the records marked classified “would impose irreparable harm on the government and public” and should not be allowed.

Trump’s Response

The government’s arguments assume, without presenting proof, that the documents marked classified are classified, Trump’s lawyers said in the new filing, which was lodged in response to the government motion.

They said that all government records, regardless of classification, fall under the Presidential Records Act or the Federal Records Act. Each record falls under one or the other; none fall under both.

Under the presidential act, Trump has an interest in and ability to access records from when he was president, according to the new filing.

“To the extent certain of the seized materials constitute Presidential records, a former President has an unfettered right of access to his Presidential records even though he may not ‘own’ them,” Trump lawyers said, citing an exception to access that states “the Presidential records of a former President shall be available to such former President or the former President’s designated representative.”

Trump’s position is that judges and others cannot make determinations on the documents without a “thoughtful, organized review” by the special master—and lawyers for the former president said the government should not be permitted to keep using the documents for its criminal probe because they “may very well be off limits.”

The new filing came shortly before the first hearing was scheduled involving the special master, U.S. District Judge Raymond Dearie, a Reagan appointee, to go over details of Dearie’s potential review of the seized materials.

George Phillips, an elderly man from Walled Lake, Michigan, was going up to bed, when his wife told him that he'd left the light on in the garden shed, which she could see from the bedroom window. George opened the back door to go turnoff the light, but saw that there were people in the shed stealing things.

He phoned the police, who asked "Is someone in your house?"

He said "No," but some people are breaking into my garden shed and stealing from me ."

Then the police dispatcher said "All patrols are busy, you should lock your doors and an officer will be along when one is available"

George said, "Okay." He hung up the phone and counted to 30. Then he phoned the police again.

"Hello, I just called you a few seconds ago because there were people stealing things from my shed. Well, you don't have to worry about them now because I just shot and killed them both; the dogs are eating them right now," and he hung up.

Within five minutes, six Police Cars, a SWAT Team, a Helicopter, two Fire Trucks, a Paramedic and an Ambulance showed up at the Phillips' residence, and caught the burglars red-handed.

One of the Policemen said to George, "I thought you said that you'd shot them!"

George said, "I thought you said there was nobody available!"

The next two waves against American society will, in my humble opinion, be as follows and both have actually already begun:

a) First, there will be more concerted efforts to "muck" up the mid -term election so whomever wins there will be deep dis-trust in the results.  

This is critically important because the one thing that separates America from most 3rd world nations is we have always had reasonably trustworthy elections. Jimmy Carter tried to rebuild his own image by going around the world seeking to insure voting and elections were honest.

b) The second item I believe that will spread is the sexualization of our grade school children.  They are already subject to random efforts to inculcate them in sexual matters in the classroom and sexually explicit books on school library shelves.  

If those who hate America and deem us a racially biased nation can wreck an entire generation of grade level schoolers on top of CRT, what China did regarding COVID and Democrat Governors accomplished by shutting down schools (ably assisted by the Teacher Union's shakedown efforts)  we will have an entire generation that hates America, cannot add or subtract or even write, be terribly confused as to who they are and America's history and certainly incapable of defending our nation should they be called upon. 

The finest military in the world is under attack from within by the current crop of leaders who are spending training and preparedness time on social theorem and racial attitudes etc,

Those of an opposite view may challenge my concerns and effects/affects but, again, they cannot deny my facts unless facts no longer matter to them and that list is also growing.

I am being tongue in cheek, but perhaps a good war, with Iran, would actually be a positive development because it might unify our nation before we decline to the point where we are no longer able to defend ourselves even against Canada , Brazil or Mexico.

Politics was always a nasty back stabbing "business" but over the last few years it has gotten nastier.

Weaponizing and personal attacks have escalated as money continues to pour in and with more billionaires getting involved money becomes no object. 

Zuckerberg, alone, spent almost one half billion dollars on candidates and causes of his choice and then there is Soros and a few more California billionaires who spent money with abandon. What chance do "we the people" have against such power.

Where and when this ends, if ever, is anyone's guess but serious money intends to bring about serious results. These billionaires expect a decent return on their "investment" and they make no bones about their intentions - power to control.

Meanwhile, De Santis has become the target of the left who control the radical Democrat Party because his success in going his own logical/rational way made fools of those who chose to shut down America's economy as the solution to COVID and their road to gaining power. Closing churches, schools, forcing the wearing masks, demanding vaccinations, driving individual shop owners out of business and standing aside while others financed rioters bent on destruction of entire commercial centers of major cities became the intimidating weapon of choice. 

That illegal immigrants are bringing a class action suit against De Santis, would be ludicrous if it was not so dangerous. In a previous but recent memo I stated that there were two things one should expect and the first was intrusion in our elections.  Honestly, I never envisioned illegals bringing law suits but nothing surprises me. It is as if we are witnessing "Alice In Wonderland" or Atlas Shrugged
