The Employee Retention Tax Credit Is the Biggest Covid Scam

The pandemic tax break was supposed to cost $55 billion. The bill so far: $230 billion, and rising.

It’s hard to feel sorry for the Internal Revenue Service, but cleaning up for Congress is never fun. The Covid employee retention tax credit is turning into a classic case of government waste and fraud. Congress created the mess, leaving it to the IRS to mop up.

Pandemic transfer payments and student-loan forbearance ended this year, but the employee retention tax credit (ERC) is a Covid giveaway that keeps on giving. The government has paid $230 billion in claims, including about $120 billion this year. The taxpayer bill will keep growing since employers have until April 2025 to claim the credit on wages paid through 2021.

Many employers are retroactively cashing in on the pandemic subsidy with the help of firms that take a 20% cut of payments. At the same time the IRS has retroactively tightened rules and threatened to dun ineligible employers to stop the cash grab. In September the IRS paused processing new claims until at least next year to clamp down on fraud.

Naturally, Members of Congress are blaming the IRS for both delayed and fraudulent payments. The IRS “has exacerbated applicants’ frustration and fostered an environment ripe for fraudsters,” House Ways and Means Committee Chairman Jason Smith and Arizona Rep. David Schweikert wrote to IRS Commissioner Daniel Werfel in October. But whose fault is all of this?

Congress established the ERC in March 2020 to encourage employers to keep workers on their payrolls during Covid lockdowns. House Democrats lobbied for the credit as an alternative to the Paycheck Protection Program’s (PPP) forgivable, low-interest loans for small businesses. The credit was projected to cost the government $55 billion.

Employers were initially eligible for a refundable tax credit equal to 50% of worker wages and healthcare expenses if their operations were fully or partially suspended by a government Covid order. They could also claim the credit if they experienced a 50% or greater decline in revenue relative to 2019. Payouts were capped at $5,000 per employee for 2020.

Few employers in 2020 availed themselves of the credit, while many opted for PPP loans. The ERC was on the verge of disappearing in December 2020, but then Congress extended and expanded it through June 2021 so more employers could take advantage. Congress can’t let an unnecessary program go to waste.

Under the credit’s new conditions, employers merely had to experience a 20% drop in revenue compared to 2019. They could also claim up to $7,000 per employee per quarter even if they received a PPP loan. In March 2021, Democrats extended the credit to wages paid through the end of that year and enabled small businesses that started during the pandemic to claim it.

The credit essentially became a de facto hiring subsidy that disproportionately benefited states like California and New York whose excessive lockdowns destroyed businesses. As with enhanced unemployment benefits, Congress rewarded states that stayed locked down longer. Yet even today, their unemployment rates remain significantly higher than the national average.

The ERC didn’t help businesses survive or reduce layoffs. Only after the lockdowns ended did millions of employers line up to exploit the credit. Now the IRS is scrambling to shut down the open bar.

It has retroactively issued guidance denying eligibility to employers that claim they curtailed operations owing to guidelines by the Occupational Safety and Health Administration and Centers for Disease Control and Prevention. The IRS says agency public-health guidelines aren’t a government “order.”

A California employer this month challenged the IRS guidance in federal court under the Administrative Procedure Act on grounds it was issued without public notice and comment. Meantime, Members of Congress in both parties are lambasting the IRS for writing rules they didn’t enact, even as they howl about fraudsters.

Their experimental study, along with others, has proven HF is feasible, safe, the residue is not toxic nor needs storage and  produces more than is required to begin the process.

They want to build a smaller second facility and I have put them in touch with Georgians who have the appropriate contacts for it to be located on Hutcheson Island but the Hyundai Facility has impacted available State manpower and resources. Also, our governor appears to be dragging his feet so it might the facility might be located elsewhere which would be a tragedy. Why? Because technology means high paying jobs, requires skilled personnel and would  link Georgia with other technologically oriented states.

The stock market has had a strong 2023. In fact, the S&P 500 is up more than 20% year-to-date. That’s a great return.

But it pales in comparison to the returns that nuclear energy stocks posted this year.

In 2023, the entire nuclear energy sector – best characterized by the Global X Uranium ETF (URA) – has soared nearly 50%.

The top nuclear energy stocks like uranium miner Cameco (CCJ) have doubled this year.

So, while the market has had a great year, nuclear energy stocks have had an even better one.

We think the party will continue in 2024.

And believe it or not, it may have to do with artificial intelligence

AI & The Nuclear Power Bull Market

Nuclear energy has always had a ton of potential. But it has always been risky, costly, and inefficient. 

Artificial intelligence could solve nuclear energy’s shortcomings – and actually lay the groundwork for a world of limitless energy. Just imagine a world where so much energy is produced that everyone, everywhere, can power their homes, apartments, and offices at all hours of the day, for just pennies.

Harnessing Atomic Power

Nuclear power has a bad reputation – and I get it. It has been used to create bombs that have decimated cities and destroyed lives. And when the world tried to capture that power in nuclear power plants, it often ended in catastrophe. And not once, not twice, but time and time again.  

Nuclear power deserves its bad rep. 

However, not all nuclear power is created equal. 

Specifically, there are two types: nuclear fusion and nuclear fission

To date, everything achieved with nuclear power has revolved around nuclear fission. That involves splitting apart atoms to capture and use the energy produced from the division. 

And it’s a very risky and dangerous science for two big reasons. 

First, splitting atoms creates chain reactions that must be controlled very carefully. Otherwise, they could cause meltdowns and explosions. Second, fission produces radioactive waste, which needs to be stored correctly to avoid contaminating the surrounding environment. 

Nuclear fission is dangerous stuff. 

But nuclear fusion is not.

While nuclear fission revolves around splitting atoms, nuclear fusion is all about combining them. 

Specifically, nuclear fusion is a process in which atomic nuclei combine to form a heavier nucleus, releasing a large amount of energy in the process. This energy is released in the form of light and heat. 

Importantly, nuclear fusion does not depend on any chain reactions and does not produce any radioactive waste. It is entirely stable without any negative byproducts. 

It’s the clean, safe version of nuclear power creation. 

Moreover, nuclear fusion is simply the better version of nuclear fission. That’s because fusion produces infinitely more energy than fission. 

Consider this: The sun is powered by nuclear fusion. At the sun’s core, temperatures reach up to 27 million degrees Fahrenheit – hot enough to allow nuclear fusion to take place. Under these extreme conditions, hydrogen atoms are forced together, forming helium and releasing a tremendous amount of energy. This energy is so powerful that it travels to the sun’s surface, where it then travels another 93 million miles to warm up and light the Earth. 

Nuclear fusion is powerful stuff. 

Inputting just a few pounds of hydrogen into a nuclear fusion reaction will produce as much energy as burning thousands of pounds of coal or oil. Theoretically, a small cup of hydrogen fuel could power a house for hundreds of years. Extending that thinking, a few nuclear fusion reactors could power the entire world for hundreds upon hundreds of years. 

Nuclear fusion is the key to creating limitless energy. 

If so, then why are there dozens of nuclear fission reactors in the world, yet zero nuclear fusion reactors?

Because while nuclear fission is a risky science, nuclear fusion is a tough science. Indeed, it’s so tough that no one has figured out how to make a viable nuclear fusion reactor… 

…Until December 2022.

A Critical Breakthrough for Nuclear Power

In short, the challenge of nuclear fusion boils down to something called “net energy gain.” 

Net energy gain is the difference between the energy consumed by an energy production process and the energy produced by it. It is energy output minus energy input. 

Obviously, net energy gain must be positive in order for that energy source to be viable. A negative net energy gain means the energy source consumes more energy than it produces. 

And historically, nuclear fusion has suffered from a negative net energy gain. 

That’s because the conditions under which nuclear fusion is possible are extremely energy intensive. 

Think of it this way: The only places in the universe where nuclear fusion happens naturally are in stars’ cores. These cores have incredibly unique conditions. Namely, they are unimaginably hot. For example, the sun’s core runs at around 27 million degrees Fahrenheit. Those extremely hot temperatures are what sparks nuclear fusion.  

Therefore, in order for scientists to replicate nuclear fusion on Earth, they need to create a reactor that gets and stays unfathomably hot. Getting something that hot requires a lot of energy. And so does keeping it that hot.

The Nuclear Future

Given those requirements, the math hasn’t worked out to make nuclear fusion viable. Until recently, every nuclear fusion experiment has resulted in a negative net energy gain. 

But late last year, physicists at Lawrence Livermore National Laboratory in California announced that they had created the world’s first nuclear fusion project with a positive net energy gain. 

And earlier this summer, those scientists repeated that experiment… with even better results!

That’s a huge deal. The one obstacle that has kept nuclear fusion from becoming a viable reality has just been removed.  The Livermore project has set in motion a multi-decade trend of nuclear fusion technology reshaping the world’s energy system. We now have clear visibility to the world being powered by nothing more than a few nuclear fusion reactors by 2040.

Forget oil and gas. Forget windmills and giant solar farms. In the future, all we may need to power the world is a few nuclear fusion reactors. 

Needless to say, the operators of those reactors could be the world’s most valuable companies. Their stocks could be the market’s biggest winners. 

And the time to invest in the Nuclear Fusion Revolution is now.

I like to stay on the cutting edge of world-changing technological developments. That’s where all the big money is made on Wall Street – taking big and bold stakes on early stage companies pioneering breakthrough technologies.

Oh, and Helion Energy – the startup that Microsoft is buying nuclear fusion energy from – is backed by Sam Altman, CEO of OpenAI – creator of ChatGPT.
