Congress Eyes Investigation Into Anti-Israel Bias at Biden Justice Department

By Adam Kredo

The Biden administration’s decision to launch an unprecedented investigation into Israel’s accidental shooting of a Palestinian-American reporter has landed the administration in hot water with Congress, which is signaling it will launch its own probe into anti-Israel bias and politicization at the Justice Department.

Attorney General Merrick Garland and "everyone involved in this disgraceful stunt should be investigated and then either fired or impeached," Sen. Ted Cruz (R., Texas) told the Washington Free Beacon. The senator’s comments come just days after the Justice Department shocked the American Jewish community and Israeli government when it announced it would investigate the May 2022 shooting of Shireen Abu Akleh, a Palestinian-American Al Jazeera reporter who was killed during a standoff between Israeli forces and Palestinian terrorists. Congressional investigators want to know who signed off on this investigation and whether it was motivated by anti-Israel bias.

The DOJ’s investigation comes after Israel in coordination with the U.S. State Department conducted its own investigation into the matter. Israel determined Abu Akleh was killed by a stray bullet fired by an Israeli soldier and deemed the death accidental. The State Department said it was satisfied with the investigation, but Biden’s DOJ overrode this assessment on Monday when it informed the Israeli government the FBI would get involved.

Cruz and other congressional officials who spoke to the Free Beacon said the DOJ’s decision to target Israel is the result of the federal law enforcement agency’s politicization under President Joe Biden. Biden Justice Department appointee Kristen Clarke, for instance, came under fire during her Senate confirmation hearing after the Free Beacon revealed she edited a law journal that featured an anti-Semitic black nationalist who peddles conspiracy theories about Jews. The only way to root out this bias, sources said, is for Congress to launch an investigation into the DOJ’s anti-Israel agenda, which has been fueled by a cadre of anti-Semitic lawmakers in Congress known as "the Squad." These lawmakers, which include Reps. Ilhan Omar (D., Minn.) and Rashida Tlaib (D., Mich.), pressured the DOJ for months to investigate the Abu Akleh shooting.

Garland is "using the FBI to attack and undermine one of our closest allies at the behest of the anti-Semitic Squad," Cruz said. "Merrick Garland has already done more damage to the FBI’s credibility and legitimacy than anyone in history, including [Richard] Nixon’s [attorney general] who was literally sent to prison."

Two senior congressional officials tracking the situation told the Free Beacon that the DOJ should prepare to face its own probe into politicized weaponization.

"We're going to find out who thought it was a good idea to unleash the FBI on Israel and reopen something that everyone else—including the president's State Department—had already resolved," said one of the sources, who was not authorized to speak on the record.

The second source, also not authorized to speak on record, said the DOJ’s probe is the result of the president hiring far-left progressive activists, including anti-Israel agitators, who are now working at all levels of government.

"Biden has seemingly filled every department with woke activists who hate Israel, and now they’re burrowing in," said the source, a veteran congressional official who works on Israeli issues. "They’re everywhere. It’s going to take years of investigations and work, and ultimately a new president, to even begin to fix the problem."

Pro-Israel organizations are also applying pressure on Congress to find out why the DOJ decided to reopen the Abu Akleh case.

"It is both shocking and appalling that the Department of Justice has allowed anti-Israel Members of Congress to pressure an allegedly independent arm of the executive branch into this investigation," Pastor John Hagee, founder of Christians United for Israel (CUFI), the nation’s largest pro-Israel advocacy organization, said in a statement.

A senior official with a pro-Israel organization told the Free Beacon the DOJ probe "smacks of politics." The probe was announced shortly after conservative Israeli leader Benjamin Netanyahu—who was close with former president Donald Trump—was reelected as the country’s prime minister.

"This investigation, coupled with its being made public coming one week after the midterms, smacks of politics," said the source, who could only speak on background while criticizing the administration.

A State Department spokesman declined to answer Free Beacon questions about what changed in the time between its assessment the case was resolved adequately and the DOJ’s backtrack. The DOJ declined to comment on the matter.

Israeli leaders have made clear they will not comply with the DOJ.

"Our soldiers will not be investigated by the FBI or by any other foreign country or entity, however friendly it may be," outgoing Israeli prime minister Yair Lapid said on Tuesday. "The IDF thoroughly investigates any irregular event and is committed to the values and laws of democracy."

Palestinian children wear necklaces with pictures of their dead terrorist “role models”

Nan Jacques Zilberdik

The latest trend in the PA is a new kind of jewelry: Necklace-amulets with pictures of terrorist “Martyrs” on them!

Hisham, a storeowner in Nablus who makes these necklaces, named specific terrorists who are most popular. All of them have carried out shooting attacks and some of them were members of the terror cell The Lion’s Den. Official PA TV reported that kids and youth are buying the necklaces, showing a very young boy wearing two with pictures of armed terrorists:

Official PA TV reporter: “The Martyrs die, but their life stories remain in the Palestinian landscape. In the heart of the old city of Nablus, Hisham strives to create necklaces of Martyrs. A necklace of cord with a picture of one of the Martyrs, which is printed on a protective amulet. The Martyrs themselves customarily wear it from time to time...”

Storeowner Hisham: “Every [Martyr] has his own status, but Muhammad Al-Azizi, Abboud [Abd Al-Rahman] Sobeh (i.e., terrorists, shot at Israeli soldiers), Ibrahim Al-Nabulsi (i.e., terrorist, responsible for numerous shooting attacks), Wadi’ Al-Houh (i.e., terrorist, shot at Israeli soldiers), and Tamer Al-Kilani (i.e., terrorist, responsible for numerous shooting attacks) – you could say that there is a special demand for them.”

Reporter: “Children, young people, and youth come to Hisham’s store for necklaces and national products. Each one comes here to choose a necklace with the picture of the Martyrs who are their role models.”

[Official PA TV News, Nov. 5, 2022]

Palestinian Media Watch has exposed the PA’s all-encompassing idolization of terrorists in general and terrorist “Martyrs” in particular. From among the terrorists named as particularly popular by the storeowner in Nablus, PMW has reported extensively on the glorification of Ibrahim Al-Nabulsi, who was a member of the Al-Aqsa Martyrs’ Brigades (Fatah’s military wing) and responsible for a series of shooting attacks. PMW also reported on an event held by Nablus marking 40 days since the deaths of terrorists Sobeh and Al-Azizi. At the event, a Fatah official “emphasize[d] the unity of the blood and the Martyrs, and that the path of our Palestinian people is resistance.”

All the “Martyrs” mentioned by the storeowner were terrorists:

Abd Al-Rahman Jamal Sobeh and Muhammad Bashar Al-Azizi – Palestinian terrorists who shot at Israeli soldiers conducting a counter-terror operation in Nablus on July 24, 2022. The soldiers returned fire, killing Sobeh and Al-Azizi.

Ibrahim Al-Nabulsi – Palestinian terrorist and member of the Al-Aqsa Martyrs’ Brigades (Fatah’s military wing) who was responsible for a series of shooting attacks targeting Israeli soldiers. Al-Nabulsi resisted arrest and shot at Israeli soldiers who returned fire and killed him in Nablus on Aug. 9, 2022. Al-Nabulsi was a member of a Fatah terror cell that was attacked while planning an imminent attack on Feb. 8, 2022; while Al-Nabulsi escaped, three other members of the cell were shot and killed: Adham Mabrouka Al-Shishani, Muhammad Al-Dakhil, and Ashraf Mubaslat.

Wadi’ Al-Houh, Ali Antar, Hamdi Qayyim, Mash’al Baghdadi, Hamdi Sharaf – Palestinian terrorists and members of the independent terror cell “the Lion’s Den” who shot at Israeli soldiers raiding and destroying a headquarters and weapons and explosives laboratory of the cell in Nablus on Oct. 25, 2022. The soldiers returned fire in self-defense, killing the 5 terrorists. Al-Houh was a senior member of “the Lion’s Den.” During the raid PA Security Forces shot at the Israeli soldiers, who returned fire in self-defense and wounded several of them.

Tamer Al-Kilani – 33-year-old Palestinian terrorist and senior member of the independent terror cell “the Lion’s Den” who was responsible for numerous shooting attacks, including an attempted shooting and explosives attack by terrorist Muhammad Al-Minawi in Tel Aviv that was thwarted by Israeli security forces on Sept. 8, 2022. Al-Kilani was assassinated in a targeted bombing in Nablus on Oct. 23, 2022.

The Lion's Den - an independent Palestinian terror cell largely based in Nablus. It has not stated an official affiliation and its members come from a variety of terror organizations, including Fatah's military wing the Al-Aqsa Martyrs' Brigades, Hamas, and Islamic Jihad. The Lion's Den was responsible for numerous shooting attacks in the West Bank during 2022, with an uptick in shootings during September-October. Two of the main founders of the cell were Fatah terrorists Muhammad Al-Azizi and Ibrahim Al-Nabulsi, both killed in shootouts with Israeli forces on July 24, 2022 and Aug. 9, 2022 respectively.

FEATURED ANALYSIS

Affirmative Action on Shaky Ground

In Defining Ideas, Richard Epstein explains that the policy of using affirmative action in admissions decisions to state colleges and universities and federally funded recipients in higher education is likely to fall when the justices of the US Supreme Court ultimately decide on lawsuits brought by the Students for Fair Treatment against Harvard College and the University of North Carolina (UNC).

Epstein criticizes the majority opinion written by Justice Sandra Day O’Connor in Grutter v. Bollinger (2003) that identifies race as a “plus factor” accompanied by the consideration of the applicant’s “academic ability with a flexible assessment of [their] talents, experiences, and potential to contribute to the learning of those around them.”

Harvard and UNC are applying this “plus factor” in their arguments, contending that while race might help a candidate, it cannot hurt them. But as Epstein, explains, if members of some racial or ethnic group are being systematically awarded bonus points for admission, those who don’t receive those advantages are being punished.

Epstein concludes with two observations. First, the conservative majority of the court believes that if race is being used to favor one applicant above another, such a practice would be in violation of the 14th amendment’s Equal Protection Clause.

Second, Epstein sees an irony in which Harvard and UNC are seeking an exemption of antidiscrimination laws they usually support.

“Affirmative action as we know it is going to fall—it is just that no one knows exactly what adaptions will be made to preserve some fraction of the ingrained practices,” Epstein writes.

SCOTUS Can Uphold Either Race-Based College Admissions or Constitutional Equality

In The Federalist, John Yoo and Alison Somin also examine the issue of affirmative action that is currently before the high court. They argue that the court should strike down such racial preferences upheld in the Grutter decision on the grounds of the 14th Amendment right to equal protection.

They maintain that evidence indicates that racial preferences often harm their intended beneficiaries. A better way for opportunities to be guaranteed for all Americans is by enforcing other constitutional rights, Yoo and Somin argue.

These include removing arbitrary and legal barriers that restrict competition in the marketplace, upholding parents’ rights to pursue a variety of school choice options, eliminating zoning laws that deprive individuals of their constitutionally protected property rights, and reversing other forms of racial preferences, including those in K–12 education and others that have metastasized during the COVID-19 pandemic.

“The limiting language in Grutter should not trick us into believing that racial preferences in college admissions have been only a modest departure from the principle that individuals should be treated as individuals,” Yoo and Somin assert. “A Supreme Court opinion overturning Grutter is essential to ensuring that individuals are not reduced to membership in their racial or ethnic groups and that we return to the Declaration of Independence’s claim that we are created equal.”

I attended a meeting today of a straight arrow former FBI employee now whistleblower  efforts to turn1/6 into a political hatchet job as I always expected.

Most government agencies are lethargic and poorly managed.  Three are absolutely corrupt and need total overhauls.  Wray should be fired along with virtually every one at the top of the FBI.

Now that the election is over the FBI claims to have found nothing at Mar-a-Largo. It was always a way to get voter attention shifted from Biden onto Trump and it worked.

I seriously doubt Franklin envisioned what we have as a current republic is what he wanted us to keep. It is corrupt to the core.

Now Jordan is going to give Biden some hickeys.
