My friend was a former legislator and now he reads my memos:

"I know they stole the election. They did it first requesting absentee ballots in the names of folks in “poor” neighborhoods, churches, nursing homes any pocket, group. When ballots arrived, they were harvested (perhaps paying for them) and voted en mass. Thus, we had the highest percentage voter turnout probably forever, and no one had to be dragged to the polls. If Biden were a healer rather than a heel he would congratulate Trump for accomplishing a miracle with respect to prospectively  saving tens of thousands of lives by virtue of the fact that he demanded vaccines be produced at warp speed when everyone said it could not be done and he was mocked and vilified by the (m)ass media.

This is a friend of my friend and fellow memo reader and he asks some pertinent questions:

THE AUDACITY OF THIS MAN TRUMP

I’m still trying to understand what 80 million voters disliked about President Trump so much that they decided to cast their votes for a man who served forty-seven years in government and has done absolutely nothing for the American people. And, I’m still flabbergasted that those same people would vote for a woman to serve as Vice President, a heartbeat away from the Presidency, with a rather checkered and not so moral past. I wondered why they despised and hated President Trump so much.
 
And so, I have many questions:
Did you dislike that Trump made cruelty to animals a felony?
 
Did you dislike he raised billions to stop the opioid crisis? 
 
Perhaps you feel that he destroyed ISIS, killed terrorists, including the leader of ISIS and the Iranian General responsible for thousands of American deaths, all without going to war? 
 
Did you dislike the fact that the media and Democrats, Joy Behar and Whoopi Goldberg, Chris Cuomo, and Jim Acosta said we’d be in World War III by now with North Korea, and their prophecies did not come to pass?
 
Did you dislike Trump because under his leadership we became energy-independent and an exporter rather than an importer of oil, no longer relying on the Middle East for our petroleum needs? 
 
Did you dislike him because he wanted to build a wall to keep criminals and drugs from coming into our country?
 
Did you dislike him because he just slashed the price for medications in some cases by 50%, which is driving big Pharma nuts?
 
Perhaps you dislike that he signed a law ending the gag-order on pharmacists that prevented them from sharing money-saving options on prescriptions? 
 
Is your dislike for President Trump based on the fact that he signed the Save Our Seas Act, which funds $10 million per year to clean tons of plastic and garbage from the ocean?  
 
Did you dislike that he signed a bill for airports to provide breastfeeding stations for nursing moms?
 
How about the fact that he signed the biggest wilderness protection and conservation bill in a decade, designating 375,000 acres as protected land, was that why you dislike him?
 
Did you dislike that he loves America and puts Americans first?
 
Did you dislike that he made a gay man the ambassador to Germany and then asked him to clean up national security and un-classify as much of it as possible for transparency?
 
Did you dislike that he’s kept almost every campaign promise (with zero support from Congress who work against him daily!) plus 100 more promises because Washington was much more broken than he or any of us thought?
 
Do you dislike that he works for free, donating his entire $400,000 salary to different charities?
 
Did you feel that he did this for four years because he was “showboating?” 
 
Do you dislike that he’s done more for the black community than every other President?
 
Do you dislike that he listened to senator Scott and passed Invest In Opportunity Zones to help minorities?
 
Do you dislike that he passed prison reform, which gives people a second chance and has made quite a huge difference for the black communities?
 
Do you dislike that he passed VA reforms to benefit the very people who served our country and defend our freedom?
 
Do you dislike that he’s winning and signing new trade deals that benefit Americans, instead of costing us more?
 
Did you dislike him because, unlike all of the presidents who came before him, he recognized Jerusalem as the Capital of Israel, relocated the U.S. Embassy from Tel Aviv there, and then proceeded to negotiate four peace accords between Israel and Arab Nations when many in the media were predicting there would be war? Was that why you disliked him?
 
Do you dislike that he loves his flag and his country?
 
Do you dislike that he calls out and has shown time and time again that the mainstream media in our country has become corrupt and incompetent, twisting the truth to control and mislead the people and he is trying to protect us from this?
 
Do you dislike that he has been a President totally committed to ending wars and bringing our troops home?   
 
Perhaps you dislike the stern way he spoke, publicly to NATO allies to step up and pay their commitments to defense rather than expecting America to do it for them, something we have done for over seventy-five years? 
 
Do you dislike that he has made a commitment to end child-trafficking and crimes against humanity and has made 1000’s of arrests already?
 
Do you dislike he’s brought home over 40 Americans held captive, the last one from Iran?
 
Do you dislike that he’s proven he was right about the Deep State and he was indeed spied on before, during, and after he became President?
 
Do you dislike that he was a Billionaire before he ran for President and now is worth at least 1/3 less... because he loves America?
 
Do you dislike that he respects cops, veterans, ICE & First Responders?
 
Do you dislike that he does not sell out America to other countries, like the leaders prior to him have done?
 
Could it be possible that the ones who sell out America to line their pockets own the media and Hollywood and hate him so much for trying to expose them and hate him for putting the American people first that they try to manipulate our thinking and control the information we get to try to cultivate hatred for him?  These people benefit when you hate the man trying to stop them... so they won’t have to give up the wealth they have gotten and continue to get thru mass taxation and control. Wouldn’t you at least want to research this possibility?
 
Could 75 million Americans already know the truth... that he has done more for blacks in the last 20 years than our last 5 presidents put together and is actually not a racist and never has been one… but you believe he is because it has been drilled into your head and yet you’ve never researched his accomplishments?
 
You can start by watching those daily briefings he did during the lockdown (all online) and then watching the coverage on the Main Stream Media and how they twisted it.
 
Do you actually believe the President encouraged America to inject bleach?
 
Did you research the effects of UV light which is used to disinfect school busses and medical equipment and is also being used as a treatment for bacteria and respiratory infections?  They want you to believe he is stupid because if you figure out that he isn’t, they will lose billions of dollars and all their control.
 
I know... it is hard to let go of what you believed to be true for most of your life. You are not alone. But your blind hatred of this man who is literally trying to save us from the far left, radical Socialists is going to be detrimental to our country if you continue to support their hatred.
 
They are teaching hatred and separation...to our children and even to our families! You are not allowed to agree with “part” of their agenda and think for yourself; you must repeat their full belief system, or name-calling and insults ensue. 
 
This is not an informed debate.  It is not a reason. This is the very definition of a cult! All or nothing! They despise law and order. Just look around you. He supports law and order, not looting, rioting, and chaos, so we are safe and can live in a civilized society. He stands for unity and America first. Is that why you dislike him?
 
You will be amazed at how much more peace comes into your life when you turn off the fake news and tune into what America stands for, where we focus on what unites us, not what divides us. The media has despised him from day one. Impeachment was on the table before he even took the oath of office in January 2017. They said Impeach the “motherfuc#^*r”....but then they turn around and say his rhetoric is bad? He was never given a chance, yet he’s done more in 4 years than any president with zero help from the media or democrats. Results don’t lie.
 
The media and democrats consistently complain about Trump “mismanaging the Covid Crisis." Nothing could be further from the truth. The man has been a rock and his leadership has kept the nation from the abyss. He promised a vaccine before the end of 2020. They said it could not be done. He proved them wrong once again….doses of the vaccine are being delivered now in mid-December! 
 
He built hospitals in NYC and California, sent retrofitted Navy Hospital Ships which went unused, initiated Operation Warp Speed that produced PPE and therapeutics in record time along with thousands of ventilators, far more than we needed, and which are now being sent all over the world. And the overall death rate from Covid stands at less than one percent!
 
How dare this man, the President of the United States, care so much about the American people and our Country. How dare he stand at attention and salute our Flag, support our troops, honor our veterans, put God back into our lives, protect the unborn, give people second chances and take seriously his oath to preserve, protect and defend the Constitution of the United States.
 
How dare this man show up at 2:00 AM at Dover Air Force Base to welcome home hostages held in foreign lands and the remains of our fallen soldiers. 
 
How dare this man develop and implement plans and programs to create the greatest most prosperous economy and standard of living in the history of mankind. 
 
How dare he reduce unemployment to 3.4% and lower unemployment for Black, Asian and Hispanic communities in fifty years! 
 
You would think this man was trying to actually do things rather than speak eloquently and act “Presidential” and “Cool” about such things. 
 
How dare he!
 
One would think this President was trying to provide leadership. 
 
How crass.
 
The audacity of this man.
 
You would think he is trying to be a leader or something

When one thinks of Trump and his family this is what comes to my mind.

They were deemed Eastern Clampert Types who moved into an elite neighborhood but their reputation moved in ahead of them.  Throughout their tenure, they were toilet papered,  shunned, no one came to welcome them and they were spied upon. Had they a pet dog it would have been poisoned. When they walked around the neighborhood their neighbors hid behind curtains and watched their every move. They were treated like blacks who moved into a fancy gated community bent on destroying property values.

They never had a chance because they were hated from the git go. Why was this?  It was because they did not fit in and, though they were wealthy enough, they were not classy enough. They even had a daughter who married a Jew and converted. The head of the household had been divorced many times and now was married to a foreigner who had been a model in her previous life. They just were not capable of measuring up, so their elite neighbors decided to engage in concerted effort to smear them, to make their lives miserable and eventually to force them to move out after their lease was up and so they did.

This is the way liberals act when they feel aggrieved and they will go to any length to have their way . Hypocrisy is engrained in their soul and is part of their DNA. 

On January 20, the Trump "Clamperts" will vacate their leased home but what they were made to endure will not cease because Trump Haters have  the "chutzpah" to think they are so virtuous they will hounded these "Clampert types" and pursue them as  "criminals" because that is the way liberals act. They are seldom happy unless things go their way and they can smear you.

Another Rant:

SCOTUS has ended it, and now the electoral college finalized it. Biden will be president, at least for a while. I had predicted Trump would win, but apparently I was wrong, or maybe I was almost right. We will never really know.

 

I don’t think there is any question Joe was on the take all these years, and Hunter was the bag man. The prosecutors have issued supposedly 24 criminal subpoenas.  They don’t do that just for missing a single failure to declare $400,000 of income. This is way bigger than some failure to declare  income one year.  Joe got his 10%, and as Hunter said in an email to his sister, he was annoyed to have to give so much of the money to Dad. There is zero question Joe was deeply involved based on the first hand testimony and emails Bobalinsky has provided to the FBI and US Attorney. It is unclear how long before the indictments come, and if Barr will name special counsel, which he should.  I believe Hunter is guilty of taking massive bribes, well beyond what we know now, money laundering, securities fraud and possibly the child porn that has been rumored. The press keeps saying Hunter is a “troubled guy”, but he really a major crook and drug addict. Remember when they rolled out the letter from 55 national security experts saying it was Russian disinformation. Nobody but Fox listened, or reported, when Ratcliffe said no it is not. This is not the little BS stuff that the brothers of other presidents did.

 

Then we have the investigation of brother James in PA, and there was also the corrupt contract to James in Iraq for which he had zero qualifications. Joe and Jill had keys to the office where Hunter and the Chinese had their company, and presumably the “chairman” had an office there, but Joe had no idea what that office he shared was for, or who the Chinese guy sitting there was???  But the press never has asked what that was all about, and how he can have an office at a company but never know what the company was. The press has now proven they are totally corrupt and dishonest. Even now, they refuse to even ask Joe one question about it, other than Fox. Some still don’t even report on it. Several have not covered Swalwell. Now we can speculate if the real reason Joe hid in the basement was to avoid anyone asking about Hunter and James.

 

Trump was right.  The Bidens are a criminal family, and China has the ability to blackmail Joe, as do others. He is the Manchurian candidate come to real life, and the press continues to try to claim Joe is innocent, and not a subject of the investigation. They were wrong about Hunter, so there is no reason to believe anything they say about Joe, who they are protecting. While you are at it, don’t forget how Joe altered the bankruptcy bill decades ago for MBNA, and then later sold his $200,000 house to an MBNA executive for a price that was several times its then value. House prices in DL did not rise 600% in 20 years. Only his house did. And now the Chinese businessman and official who was Hunter’s partner has “disappeared”.

 

Barr did exactly the right thing not to say anything per DOJ rules. It would have been trashed by the press as an election ploy, and not real, but this way nobody can say that. Now the investigation cannot be attacked as a Trump diversion. It very possibly may have changed the outcome, but we will never know. Now that Barr has resigned, we will see if the acting appoints a special counsel for the Hunter case. Barr did  a great job as AG and likely just decided he was going to spend Christmas with his family and relax, and be done with all of this to save his personal legacy.

 

What we now need to worry about is Joe being forced to resign in the next year as the indictments come, and the prosecutors lay it all out. Millions went somewhere and Joe has been living well beyond his nominal income. In addition we have Biden’s cognitive decline which will get more apparent as he is more exposed.  He could not even remember how to pronounce Bacerra’s name. Then, in addition,  Durham comes on top of that, and since he has just expanded his team and expanded his investigation, and is now special counsel, it will be the blockbuster I have been predicting.

 

Standby for president Harris potentially.  It is now a very real possibility. The Republicans will have a real dilemma. If they push for Biden to leave, we get president Harris and a Pelosi VP until a new VP is selected.  Then that VP nomination will be a radical who Republicans will vote against. 2021 is potentially going to be a year of major chaos and constitutional crisis.. As a result, the Republicans should be able to take the House in 22, and the White House in 24 once all of this is laid out publicly. Trump will say, I told you so, and that the press is corrupt, and fake news, and he will be correct. Meantime China and Iran will take advantage. Just when you thought nothing could be worse than 2020.

 

There seems to be no question the Dems used mail in voting as we all worried they would, but the RNC blew it completely by not going after the problems before the election. Had they moved in court in October, some of their cases would have been pursued by courts. Several failed due to laches- delay. As I had said in September and October, Pelosi wanted mail in badly for a reason. In GA, the secy of state blew it completely. They also really blew it in PA. At least on Jan 5 there will be so many watchers, and checks on signatures, that it will be honest. All of the Biden mess will likely help to get Republicans out to vote, as will the party line of the election being stolen. Now a group of black ministers has come out against Warnock over abortion-a big issue in GA. It is all about get out the vote. It is probable that Loeffler and Perdue will both win, but until it is over we can’t be sure. Then Abrams will declare the vote to be rigged, and the press will take her side again. Hypocrisy once again.

 

So now 77% of Republicans and 27% of independents, and even 10% of Dems  think Trump really won. We know we can’t trust the FBI, or parts of the intelligence community. We see mayors and city councils trashing cops and defunding them, and the press and big corporations and school systems buying into the BLM propaganda, and schools using the 1619 project books. Crime is spiraling out of control in major cities, and city councils and mayors of those places are letting it happen, and blaming the cops, and calling us all racists.

 

We see universities brain washing kids with left wing ideology, and teaching them is it perfectly OK to quash freedom of speech when you don’t like what someone says or thinks. We know the press is totally corrupt and biased, and the news is fake much of the time.  And now we have a true crook about to become president, and a Congressman on the intel committee who has been compromised. We need to go all in for Jan 5, and for 2022 elections. The country is on the precipice, and we need to pull it back. They tried to impeach Trump for Russia collusion of which there was none, and then for a call with Ukraine to ask about Hunter, which was now known to be a very legit request. But Swalwell was sleeping with a Chinese agent, and she was putting an intern in his office, but Pelosi thinks it is fine for him to be on Intel. Meantime Don Jr was pounded by the media for a twenty minute meeting with some Russians where nothing happened. Sometimes I think I live in another country.

 

Between the Hunter case, and Operation Warp Speed, Trump will be vindicated. Warp Speed by all accounts from non-partisan health experts was a true historic miracle accomplishment, and will save hundreds of thousands of lives. We need to hope Biden and his people don’t screw with it, and mess it up now.  Someone should ask him in March if he thought the system had worked well and saved lives. He said Trump had no plan, and was responsible for killing tens of thousands of people, and that is the line the press pushed. Now we see how totally wrong they were. The vaccine has been a massive logistics and management undertaking unlike any before.  Trump was able to pull together private and public assets, and create well led teams to make it happen. From there the general and the drug companies made it happen. It was a spectacular team effort with great leadership. And Biden and Harris get Person of the Year from Time. It is like Obama getting the Nobel Prize for showing up for work.  

 

The Dems are destroying lives with all the shutdowns. Millions of individuals started small businesses, and now are getting crushed and destroyed. We all know how bad the virus is, and how to be careful, and how to run our own lives. If people choose to go out and take the chance of getting sick, that is their decision, not the government’s role to control. The government informs, and then individuals should be left to make their own decisions as to what to do with their own life. Some people go out and do things that risk their lives every day, and some die every die as a result. Some argue that it is the government’s role to protect the citizens, but they are destroying millions of people’s lives with the shutdowns. They are forcing millions to be unemployed unnecessarily. The damage to young kids is unrecoverable, especially for minority kids and their parents. Then they refuse to give in on liability protection for these small businesses to appease their plaintiff lawyer supporters.

 

It is OK for Target and Home Depot to be open, but not the small restaurant around the corner. This is going to cause a major revolution in the next elections. CA and NY could actually go Red. As someone who started several companies, I am heartbroken to watch these risk taking  entrepreneurs get ruined by politicians. The contraction rate for restaurants in NY is 1.4%, while it is around 75% due to gatherings in homes, but restaurants get shut down. Religious services are limited, but protests are OK. Here in FL we are free to go about our lives as almost normal. FL economy is booming, and thousands of people from the north arrive daily, but in CA and NY, the big taxpayers are fleeing daily. In red states the unemployment rate is under 6% in several, but over 9% in blue states, and is about to rise with the new shutdowns. Is there something they don’t get? The data are clear. In Fl we play tennis, go to restaurants and bars, and church, if we choose to, and enjoy life. I was just in a restaurant and nearby 8 older people were enjoying dinner at the same table.  We choose what we do , not the government. And our taxes are much lower. You might notice how Biden stopped demanding a 100 day mask mandate.  Nobody was caring what he has to say.

 

What to make of all of this for investing. That is very hard to know. The main thing is still Jan 5. If the Republicans win, then there is some hope to mitigate what would otherwise be a radical set of new laws and regulations. It will leave Republicans in charge of committees to undertake investigations, and to stall or turn down the worst of Biden’s nominations like Bacerra.  It also means they have a real way to affect the budget, which is key.  And if my Biden resignation scenario does happen, then they can keep a left wing nut from becoming VP since the Senate has to approve the person. With the vaccine starting to be administered, the economy will be recovering fairly quickly by April, as things are reopened. The Hunter indictments will not likely happen until early spring as they go through the grand jury and other legal processes. The prosecutors will be absolutely certain they have clear and irrefutable evidence before they issue the indictments. Hopefully there will be a special prosecutor.

 

So for the next few months there will be no bad impact on the market  assuming the Jan 5 vote goes Republican, and the vaccine distribution goes well. If Jan 5 does not, be out on Jan 6, or if it looks like a Dem win is coming, be out before. So we are very likely to have a rapidly recovering economy here, and around the world during 21, but chaos in DC as the Hunter case unfolds, and Durham follows behind that. It will be a lot  like  Watergate, only far worse. Add to that, Iran doing something really stupid to retaliate for the assassinations, and thinking with Biden as president they can get away with attacking Israel and killing a US general or ambassador. China will then likely see the weakness in DC, and push somewhere in the world -maybe Taiwan. This all may sound crazy, but if you think of the individual pieces, and how they tie together, it is very possible. I am not predicting these things will happen, but I believe there is a good chance some, or all will, and we need to be prepared for that.

 

The markets may become vey volatile in the first half of 21 if some of these things happen, so don’t just buy the wonderful optimistic forecasts of Wall St. Be aware, and do not believe what NBC, CNN, MSNBC, the NYTimes, WAPO, or ABC tell you. It is almost certain they will be lying again. And for sure, do not believe much of anything on the internet. For the moment the market will be positive as the vaccine production ramps up. The issue for the market right now is that Wall St is ignoring these other issues, and is only focused on the vaccine, and assuming the Jan 5 result is Republican. Don’t be follower.  Keep your eye on all these other problems, and be ready to react even if Wall St says all is wonderful. They are almost always late to  recognize reality, as they were in 2008, when several of us were already long out of the market because it was obvious to us that the crash was inevitable as early as spring of 2007. Pay attention to what is really going on in the world, and make your own analysis and decisions.  

 

If you own some shares in the latest hot IPOs you are best to get out now. Snowflake is valued at 200 times revenue and more than Goldman, and twice the value of Pfizer.  Door Dash is valued the same as GM, and Airbnb is $83 billion, which is more than Fed EX. And Marriott. Newly public tech IPOs are now valued at an average of 24 times REVENUE. The average for Nasdaq stocks is 4.3x. No matter how good these tiny companies are, they can’t grow that fast. All these young CEOs are not geniuses like Bezos or Musk. This is nuts. These stocks will fall back to reality one of these days, and it will be ugly. Don’t be a pig if you happen to have a profit in any of these stocks.

 

You will sometimes hear Blackrock demanding some very liberal things of companies as the largest investor in Wall ST.  Just be aware Larry Fink wanted to be Treasury Secy, and failing that, he wants to be very influential in the Biden White House. So what you hear out of Blackrock is Fink pushing his own personal  political agenda. That is your money he is likely managing on one way or the other through ETF’s or proxy fights or some other way. 

 

Brexit was due to die, but at the last moment they decided to keep talking. Neither side wants to bear the brunt politically and economically if there is no deal at all. The issues are real, so coming to an agreement is very hard and still  not certain. They are as bad as Congress-no compromise. We will see who blinks.  It may well be the EU, but we don’t know yet.   Keep your eye on this situation as it will impact markets.

 

CA is finally about to see the reckoning for its radical policies. The tax paying base is fleeing. Until the virus, the belief was nobody wanted to leave Silicon Valley because that was where the top jobs and hot companies were. The virus changed everything. Just in the past week or so, HP, Tesla, and now Oracle, all left for TX. We are not hearing in the media about the small companies leaving, but Denver, Boise, and other cites are now seeing a flood of techies arrive. With virtual communication, over the past year, it is now well established that a lot of tech types can work anywhere effectively, and at far less cost. With those companies showing the way, it will now be deemed OK to leave for Austin or Houston or other places. The tax savings and cost of living savings is huge, and the regulatory situation is vastly different in TX and FL.

 

AZ completely blew it with their new tax. Likely a result of too many Californians moving there. There is a high probability that the Miami Dade area will become Wall St south as Goldman has shown that even the big banks can operate some of their big departments from tax free, lower cost locations. Palm Beach is going to become the southern center of the universe for many in Wall St. Over the next five years we are likely to see a shift in where financial and tech businesses operate from, and the pandemic will have been the trigger that finally made it happen with remote work. Zoom will likely be overwhelmed by Microsoft or some other tech company passing them by with even better ways to do meetings and collaborate online. They now have the ability to do remote robotic surgery, so why not remote robotic lab work, to enhance collaboration on innovative technologies.

 

There will be a major boom in online services for collaboration, but there will always be a need for face to face work in some projects that require bouncing ideas back and forth, and for the need to watch body language, as in questioning witnesses at trial. It will all evolve over the next few years, but we are never going back to Silicon Valley being the only center of the tech universe, and NY being the only center of the capital markets. Silicon Valley is not going away, but over time a material piece of the tax paying base will be gone from CA. The radical politics of the Dem run cities and states, and the rapidly improving technology of communication, will combine to change the nature of working and locating.

 

By 2024, the politics of the nation will have changed. Republicans will again be ascendant. We already see it starting in the big shift in the House elections and state level legislatures, with so many Republicans taking seats the Dems thought they could win. Republicans flipped 13 seats, and several in CA. Watch to see if Pelosi will try to refuse to seat the Republican winners in Iowa and upstate NY. She is the one stopping people and small business from getting relief and the Dems will pay a big price for that in 22. The pendulum will swing back. The big question is, will universities change also. That is where things begin with radical ideology, and that is what really needs to change.

 

Elections in NYC in November will likely see a moderate Dem or even another Giuliani get elected. The next governor of CA is very possibly going to be a Republican as the virus closedowns extract severe pain and anger, and as the young techies flee to other states. We are now in the early stages of cultural, work, and life style changes, and voting pattern changes that are not yet fully predictable. This is now the technology driven second industrial revolution I have referred to in the past. Amazon and Google are doing what the government can’t do, training low level workers how to use computers and to make them employable and able to get ahead.

 

Instead of big companies committing to hire 1 million blacks, they should instead commit to train millions of minorities in technology and basic remedial English and math they never got in school, all for free. That would do vastly more for everyone than hiring and promoting people by skin color with no real training or skills. Once again we have big companies doing what they perceive as politically correct, and publicity good, as opposed to effective solutions of the real problems of bad educations due to teachers unions, wasteful government run training which has never really worked, and poor cultural backgrounds. Big corporations have become as bad as DC politicians.

I am no lawyer but I agree with Conrad Black that we have a Chief Justice who is a great disappointment and seems more interested in shielding The SCOTUS from criticism than support it making decisions in accordance with their constitutional authority.

It would appear to me The Court could have heard the Texas Case, ruled and stated 
their decision was limited only to presidential elections where fraud was widely alleged, but then what
do I know.

Commentary

The refusal of the U.S. Supreme Court to hear the suit of Texas and 17 other states against four states (Georgia, Michigan, Pennsylvania, and Wisconsin) that were alleged not to have conducted fair presidential elections, on the grounds of Texas’s lack of standing, is a grievous abdication.

The claim of Texas and the other states was that failing to protect against fraudulent voting on a large scale that affected the results for each state, and cumulatively between the defendant states to affect the outcome of the election of the president and vice president, was a violation of Texas’s right to an adequate level of assurance that the constitutional process of selection of the president and vice president was truly followed.

The attorney general of Pennsylvania called the Texas lawsuit a “seditious” attempt to disenfranchise the people of his state, and the Trump-hating media gave it the usual total-immersion in reflexive mockery.

Official processes aren’t more important than the election of the president; no right is more fundamental than the assurance of the constitutional selection of the president. The Supreme Court’s decision can only be seen as another illustration of its determination under notoriously controversy-averse Chief Justice John Roberts to avoid any judgment that might produce a partisan backlash.

This appeared to have been the case in determining that Obamacare was a tax (which is nonsense). It’s one thing to hear a case and produce a dubious motivation for a decision, but something else to decline to hear a case in a matter not of appellate but of original Supreme Court jurisdiction—a dispute between states—on the fatuous theory that the 18 complainant states have no right to a high comfort level that the people elevated to the national offices have, in fact, been constitutionally elected.

This isn’t conscientious legal decision-making, and it is a failure to fill the judiciary’s role as the ultimate judge of the legality of what happens in the country.

Criminalization of Policy Differences

If the Supreme Court and lower courts won’t exercise their full responsibility, the judiciary ceases to be a coequal branch of the government, the Constitution cannot function, and the political direction of the country is determined in an increasingly lawless contest between political factions in the executive and legislative branches, with no determining regard to the legality of their conduct.

The role of the judiciary is then demoted to being fought over for the criminalization of policy differences—it then ceases to be just a matter of legislating, but of driving the opponent from office after a partisan conviction of “high crimes,” a term that can be redefined to suit the occasion.

I was one of those (and we were not numerous) who urged the chief justice at the end of the farcical impeachment trial of President Donald Trump in February to inveigh about the inadvisability of frivolous and vexatious attempts to remove high officeholders.

I was also one of those who warned the extremely small readership I then had nearly 50 years ago during the Watergate controversy, of the dangers of criminalizing policy differences in the U.S. government.

 But that process has become addictive and almost reflexive. No conclusive evidence has ever come to light that President Richard Nixon committed any crimes, although some members of his entourage undoubtedly did. And he didn’t discourage an ambience in the inner circles of the White House that tolerated a casual attitude toward taking liberties in the interests of national security.

The charges against President Bill Clinton were never adequately grave to justify an impeachment trial.

There was no conclusive evidence that Trump did what he was accused of doing in his impeachment case—abuse of power and obstruction of Congress, and neither is an impeachable offense (any president who wouldn’t obstruct this Congress is guilty of negligence).

The first presidential impeachment trial, of Andrew Johnson in 1868, was also preposterous—the president fired a Cabinet official, for cause.

It would have been entirely appropriate and very useful if at the end of the Trump impeachment process, the chief justice had stated, in recording the verdict of the Senate, that frivolous and vexatious harassments of presidents and other high officials for partisan reasons aren’t in the country’s interest.

 Such comments when cases are thrown out aren’t uncommon in less important matters.

A Two-Legged Stool

Something ultimately will have to be done to end this meretricious and destructive process of trying to mobilize partisan legislators to convict political opponents of crimes. But unless the judiciary fulfills its constitutional status as a coequal branch of government, it’s to this depth of squalid bloodless assassination that U.S. government will be reduced.

 It’s now a country with a totalitarian, left-of-center press, and a judiciary that is politically biased by or intimidated by the left, where, because of the pusillanimity of the Supreme Court, it’s now the law that elections may be rigged with no oversight, except within the state where the rigging occurred.

With a bench that is incapacitated in the most politically important matters, Madison’s magnificent triumvirate of equal branches of government will degenerate into a two-legged stool, in which the president will be a virtual dictator when his party controls the Congress, and he will be constantly vulnerable to harassment and threat of almost capricious removal when his opponents control the Congress.

 The judiciary would then be reduced essentially to arbitrate the immense mass of civil litigation that afflicts and throttles daily and commercial life in the United States, and to be a rubber stamp for the prosecutocracy that enjoys a 98 percent conviction rate, more than 95 percent of it without trial, in the continuous demonstration of the abuses of the plea-bargain rules that permit prosecutors to extort and suborn perjury at no legal risk to themselves or the untruthful witnesses (who receive immunity from accusations of perjury).

 Such a country, with a stunted judiciary, will shortly fall into a state of institutional decrepitude where its highest courts no longer have the moral authority to bring down judgments on the political leaders even if they had the will to do so. It would be a severely hamstrung parliamentary system in which the executive can only serve at the pleasure of legislative majorities and minority governments are dismissed from office as criminals.

 This may all seem a bit remote, but when the Supreme Court creates a vacuum by abdicating as it did last week, the vacuum created doesn’t cozily await the return of justice; the vacuum will be filled by the power-accretive politicians in the legislative and executive branches and there will be no one to mediate or arbitrate between them.

 The judiciary’s task is to assure that the Constitution is upheld. If it doesn’t play that role, the Constitution won’t be upheld. The United States could ultimately replicate Rome, where 22 of the 30 emperors elevated between Tiberius and Diocletian died violently. Presumably, there have been, in these 17 centuries of intervening decadence, enough refinement of political thought and practice, that hasty departures from the presidency won’t be violent.

 If the deterioration of the quality of the media, the courts, the elections, the candidates, and at least superficially, of the cultural standards of the people also, is not temporary, the consequences will ultimately destroy the American republic (confirming Benjamin Franklin’s famous premonition). The United States will be at the edge of a precipice, with all of Western civilization precariously attached to it.

Is America's Fourth Estate (Free Press) in Foreclosure?

The "fourth estate" refers to freedom of the press. The term may have first been used by the philosopher-statesman Edmund Burke, who in 1787 highlighted the press as free and apart from the other three British "estates" -- clergy, royalty and commoners.

The modern meaning, however, refers to the press as a fourth and free power -- as even a "watchdog" -- over the executive, legislative and judicial branches of our government. Today, however, it is the watchdog that needs watching.

The foundation on which the United States is built, freedom of speech and freedom of the press, is enshrined in the First Amendment to the US Constitution:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Before our eyes, however, this freedom is being distorted, strangled and withheld.

Young people today seem to have no idea of what the media used to be when America was more united. All the newspapers and media outlets recognized and covered the same big stories. The ideal to which journalistic professionalism aspired was objective reporting -- at least an attempt toward it -- and the media at least tried to keep "news" balanced, and separate from opinions and op-eds.

Today, journalism has changed so that the "news" is often conflated with unsupported and biased opinion. Consider Newsweek's story on Senator Ron Johnson's (R-Wis.) poll-supported claim that "Donald Trump would have won the election if the media had given more coverage to unsubstantiated allegations concerning President-elect Joe Biden's son, Hunter." The word "unsubstantiated" is the reporter's opinion -- not a certified fact. As we are seeing now, and as Senator Johnson was doubtless well aware, the allegations were smothered in substantiation. All a reporter had to do was look.

Similarly, some journalists cannot seem to hold themselves back from reporting on Trump's supposedly "baseless" claims of election fraud -- despite eyewitness affidavits, vote count anomalies, abrogations of both the Constitution and states' election laws, and the use of Dominion voting machines and Smartmatic software that are reported to have the capacity to flip votes secretly from one candidate to another.

Widely censored by both Big Tech and the mainstream media was a New York Post article which asserted that an abandoned laptop, the undisputed property of former Vice-President Joe Biden's son, Hunter, implicates him as the family "concierge" for the Biden family's influence-peddling in China -- a country cited by Director of National Intelligence John Ratcliffe as America's "National Security Threat No. 1."

Two corroborated reports in the New York Post highlighted Hunter Biden's financial interests in various foreign countries -- include his partnering with two Chinese military companies, one under investigation for espionage and the other for human rights violations. Both New York Post articles were censored -- actually totally blocked -- for two weeks by Twitter and Facebook, as was, for a time, the Twitter account of White House Press Secretary Kayleigh McEnany for having posted the contraband information.

As Glen Greenwald, who recently resigned from The Intercept, the website he co-founded, wrote, weeks before the election:

"Early in the day, users who attempted to link to the New York Post story either publicly or privately received a cryptic message rejecting the attempt as an 'error.' Later in the afternoon, Twitter changed the message, advising users that they could not post that link because the company judged its contents to be 'potentially harmful.'"

Recently, YouTube, announced that it was removing all videos accurately "claiming (that) mass fraud changed election results." Left unperturbed, however, are masses of inaccurate material, such as that President Trump allegedly colluded with Russia, or Chinese and Iranian propaganda claiming "the US army may have brought the coronavirus disease to Wuhan."

It was also, it seems, perfectly fine for the New York Times, as its editor-in-chief, Dean Baquet, admitted, to have "built our newsroom" around the fake Russia Hoax for two years, but the confirmed facts concerning the Biden family's influence peddling was apparently "not fit to print" -- especially before an election the newspaper was manipulating.

Divisions in the media have also created for the public widely divergent images of the president. To one group, President Trump is supposedly a far-right, authoritarian tyrant, allegedly seeking permanent rule; a buffoon, a fascist, racist, white supremacist, narcissist, lunatic, and incompetent, lacking in both empathy and presidential dignity.

To another group, he is the patriotic upholder of the American Constitution, a man of legendary accomplishments in office -- four more partners for peace in the Middle East (the UAE, Bahrain, Sudan and Morocco); producing and delivering a new vaccine in less than a year; expanding school choice to improve "equality"; preventing Iran from a nuclear breakout; protecting the US border from trafficking and drug smuggling, and unmasking and confronting China as a lawless, omnivorous threat. To this group, he is a Hercules, delivering for the people in spite of unrelenting attempts to undermine him, and by far the last best hope of saving the United States from an energized, appeasement-prone, increasingly socialist takeover.

Many believe that what the US has been experiencing – such as the bogus charges of collusion with Russia, a kangaroo impeachment, and now an election that appears overwhelmingly stolen -- is nothing less than a succession of attempted coups d'états, more in keeping with Russia, China, Venezuela and Cuba than with a sustainable republic.

This month, it was claimed that Republican Governor Brian Kemp of Georgia "awarded a $107 million contract to Dominion voting machines two weeks after meeting with People's Republic of China's Consul General."

Senator Chuck Schumer has already announced that he would like to "change America." He has not quite specified into what.

Transitions to tyranny -- in the name of "helping the people" -- usually take place along with the "cancel culture's" desecration of statuesre-writing of history, outbreaks of riotinglooting, murders and ongoing denigration to whip up hate.

For much of the country, the attempted coups have now been sanctified and made to seem legitimate by the election -- that many feel was "stolen" -- of former Vice-President Biden. One can surely understand how Republicans feel now that the top-ranking conspirators involved the attempted coups have captured the government through their figurehead, former Vice-President Biden.

Clearly, voter fraud must be investigated, as scheduled in upcoming hearings under Senator Ron Johnson December 16. If elections continue the same way -- by legitimizing practices that sidestep Constitutional and states' laws -- as they threaten to do in two run-off elections in Georgia on January 5, we will no longer have a viable republic. The two upcoming elections in Georgia to determine control of the Senate may end up being the last firewall of a workable, multi-party nation.

Also clear is that the election of former Vice-President Biden was made possible not only because he was supported by almost universally biased mainstream newspapers and television stations that distorted or snuffed stories at will, as well as by Wall Street corporations and Big Tech companies aching to do business with a lucrative, if hegemonic, China.

Currently, power in America is concentrated in six companies:

"News Corp, Disney, Viacom, Time Warner, CBS and Comcast own 90% of the TV stations, radio stations, movies, magazines and newspapers that 277 million Americans rely on for news and entertainment."

Those companies have been "consolidated from 50 companies back in 1983." Supporting them are supposed "fact checkers" -- often suspect, and funded in large part by liberal billionaires such as George Soros and Bill Gates who most of the time support the Democrats.

Meanwhile, countless Americans have had advertising accounts or websites abridged or closed simply because Big Tech does not agree with their views. The investigative organization "Project Veritas" exposed Twitter's "shadow banning" mainly right-of-center views, meaning that "users were blocked from the platform without even being notified."

On November 17, the Senate Judiciary Committee questioned Facebook's CEO Mark Zuckerberg and Twitter's CEO Jack Dorsey about their political bias and practices, perhaps in an effort to curb their manipulation of a tremendous market dominance of information. Republican Josh Hawley questioned Zuckerberg about one program in particular, "Tasks," which is ostensibly used to share and coordinate "security-related" information between Twitter, Facebook and Google.

Zuckerberg claimed that the coordination was confined to "terrorism and foreign government influence but not content."

Really? Then why did the media "breathlessly" cover Adam Schiff's fake "content" that the laptop scandal was "Russian disinformation," a claim emphatically denied by Director of National Intelligence John Ratcliffe.

Despite Big Tech's millions in donations to members of Congress, some members are considering revoking Section 230 of the Communications Decency Act , which provides immunity to Big Tech from content they post, or breaking up the Big Tech companies as violators of anti-trust laws, the better to enable competition.

Zuckerberg also mentioned the intention of the three media giants to support the two Democrats in the senate run-off races in Georgia on January 5. A George Soros-Bloomberg group has already contributed $300,000 to the two Democrats in their attempt to defeat incumbent Republican Senators Kelly Loeffler and David Perdue.

Of the Democratic challengers in Georgia, Jon Ossoff has had business ties with a Chinese company, PCCW Media, a telecom company, whose chairman, Richard Li, has for years opposed pro-democracy protestors in Hong Kong. The Rev. Raphael Warnock, backed by the billionaire George Soros, is anti-militaryanti-Israel, and has praised a fellow-preacher, Frederick Haynes III, "a Louis Farrakhan-supporting preacher after he compared President Donald Trump's election to the Sept. 11 terrorist attacks and applauded efforts to defund police departments."

The latest efforts by the media giants have been the attempt to discredit President Trump's claims of massive fraud in the election; claims backed up by Trump lawyers such as Rudy Giuliani, Jenna Ellis, Lin Wood and Sidney Powell, as well as various experts in technology.

How did all this come about in star-spangled America? The radicalization seems to have actually begun in our institutions of higher learning, perhaps by teachers and others in power. Many who were radical protestors in the 1960s and '70s, may well have since been indoctrinating public school children with a version of history calculated to make them despise their country and accept communism.

As presidential historian Craig Shirley has written in "They're Coming for you, Mark Zuckerberg":

"As instructed in Rules for Radicals by Saul Alinsky, the left either destroys or takes over institutions in order to gain control; power. Public education ... is now under the thumb of the left and their labor unions, and our children are not learning, except to mouth leftist bromides."

At present, radicalized schools are, not surprisingly, turning out radicalized reporters. According to a study by the National Association of Scholars, Democrat professors outnumber Republican ones by nine to one. In the Northeast, the ratio was 15.4 to one. If you want to know what happened to the Republicans, just ask Daniel Ravicher, a law professor at Miami University, censured for tweets that supported Trump.

What we are witnessing in the universities appears to be massive, Marxist-inspired group-think. It has also infested the media and other areas of society, thereby crushing another essential linchpin of democracy: the free marketplace of ideas.

If you think that a slow-motion coup seems unlikely, tune in to William Binney's interview with Chris Hedges. A former technical director of the National Security Agency (NSA), Binney maintains he retired in disgust when he realized that the NSA used the technology that he had created to spy on Americans.

One hopeful sign is that in the US, we do not have complete censorship -- at least yet. In freedom of the press lies its reverent responsibility for the freedom and welfare of the people.

As more and more news of the election fraud has comes to the attention of Americans, rallies have sprung up in support of honest elections. So far, still to be answered, is the question: If election officials can ignore legalities with impunity, how, going forward, can there be trustworthy elections?

Whatever the final outcome of the current presidential election, let us hope that the frogs are starting to jump out.

The First take: We were first told this was all fiction, that Trump and his supporters were chasing an untrue allegation. Joe Biden denied knowing anything about it on multiple occasions. These diplomatic memos tell a very different story. Is it time for a Special Counsel to be appointed to look deeper into this? We believe so.
