As I understand it Trump appointed Whitaker under a statute that allows him to do so. The question is whether the statute is constitutional because the Senate is the legislative body that has advise and consent authority where a senior appointment is involved.
No doubt the matter will ultimately be resolved by The SCOTUS. Trump appointed Whitaker to serve in an interim manner and will seek an appointment in due course.
Meanwhile, top Democrats (Schumer and Pelosi)are going bananas claiming Whitaker's appointment was done to stop the Mueller investigation.

What we are witnessing in several states is, at the very least, incompetence which has been tolerated for too long and at the very worst, as I suspect is actually the case, theft of elections.
Meanwhile, France's, two faced leader is busy stabbing our president in the back and apparently Trump haters believe Trump is wrong to place America first. Do they prefer America be second , even third or maybe they want America to lose? The Gov. of New York does not believe America ever was great and we know Michelle was not proud of America until her husband became president.What utter nonsense that we should elect a president who is unwilling to strive towards making our nation excel.
The overreach of progressive radicals should sicken anyone who cares about America.

New molecule kills brain cancer cells. Hebrew University of Jerusalem scientists have developed a molecule to treat glioblastoma, a very aggressive type of brain cancer. The molecule blocks the ability of the MKNK2 gene to produce Mnk2b – a cancer-causing protein but increases the levels of Mnk2a – an inhibitor protein.

Training rice farmers in Nigeria. Saving the coral in Palau. I reported previously (13th May) that to save their coral reefs, Hawaii had banned sunscreen ingredient BP-3 thanks to Ben-Gurion University research. Water technology for Vietnam. Israel has displayed new water technology in Hanoi, Vietnam, to improve its agricultural sector. Hanoi’s “Exposition of Futuristic Agro and Water Israeli Technologies and Cultural Performance” featured Israel’s Watergen, plus a 100-meter vertical rice field from Israel’s Vertical Field.

Drip irrigation just got even more efficient. Israeli Simcha Blass had the idea for drip irrigation over 80 years ago but it is still too expensive for 85% of farmers. Israel’s NDrip has developed a low-cost system that uses gravity, not energy. It also removes the need for filters. NDrip has just raised over $50 million of new funds.

Saving palm trees. Israel’s PlantArcBio has developed a pesticide that it says is 100% effective in fighting the deadly red palm weevil that attacks trees around the world. The UN Food and Agriculture Organization (FAO), considers the red palm weevil one of the world’s most invasive pest species, infesting palm and coconut trees.

Ford cars will make decisions. Ford Motors is investing $12.5 million in its Israeli subsidiary SAIPS so that it can build a decision-making system for Ford’s future autonomous vehicles. Successful 3D printed circuit tests. In a major breakthrough for additive manufacturing for printed electronics, tests conducted by Harris Corporation showed that 3D printed radio frequency (RF) circuits made by Israel’s Nano Dimension performed equal to that of circuits developed using conventional manufacturing techniques.

Convert any space for games. Israeli startup EyeClick’s BEAM platform converts a normal floor into an interactive playtime site, using a projection screen and dual motion sensors. 3) Commodity prices continue to decline. Oil is down below $60 just as the Iran sanctions kick in, defying the pundits, and Wall St analysts. Oil is having its worst losing streak in 34 years. That should tell you the pundits over react to these events, and solutions can be found if countries like the US work to solve these problems. It also shows that fracking has changed everything in geopolitics. That is the fracking Obama tried to end, and Cuomo refuses to allow. The US now produces 12 million barrels of oil a day, biggest in the world. Overall commodities are down around 20% this year vs stocks in the US up 6%. European economic growth is less than 1% and declining. China is slowing even more. Wherever you look, the world is slowing except for the US. There are two ways to look at this. 1. Capital is flowing to the US as a safe haven, helping to keep rates on Treasuries lower than they might have been. 2. Trump and his policies, plus a lot of fiscal stimulus, and the Fed staying generally accommodating, have created a very pro-growth economy after 8 years of Obama anti-business and over regulation approach. The last two quarters of 2016, and the first quarter of 2017 were actually declining in GDP growth rates to a low level. For Obama to try to claim he is responsible for the current growth is just blatantly absurd. How long the US can continue to grow at over 3% is hard to know if the rest of the world is getting slower, and commodities prices are declining. Good news is as oil and other commodities decline, it just means more spending money at Christmas for US consumers, as gas and heating oil prices will be declining at a key time. If oil stays low through the winter, then consumers will be more flush going into next year, and savings will rise. All good. It also means inflation stays low, and that means the Fed is under less pressure to raise as 2019 progresses if the rest of the world is slowing. However, the stock market may not rise as fast as we would expect if the fear of a world slowdown becomes more prevalent, as international corporations have slower offshore growth, and as the high dollar creates a currency translation issue in offshore earnings. Very hard to forecast right now.

The Italian battle with the EU is potentially creating a real crisis. The Germans and French subsidized their banks to avoid a real crisis in the Greek economic collapse, and they have to do the same for Italian debt held by these same banks. The problem is, Italy needs debt forgiveness, but the banks can’t take hit, so the two governments and the ECB subsidize the bad debt. We know from our own experience in 2008 that failure to just write off and modify bad debt at banks just will lead to eventual disaster. The US banks took the hit, TARP helped cover the banks, but it was a short term subsidy, and now the major US banks are in the strongest shape they ever were having written off or modifying hundreds of billions in loans . The mess was dealt with and we moved on. In Europe they never dealt with the bad debt, and are just prolonging the collapse. Zombie loans remain on bank books. France is not really solvent, and its politics are so bad now, that reform is not going to proceed. Macron tried, but has been stopped. The last Italian prime minister tried but failed. With the leadership of Merkel, Germany got strong and the rest of the EU is a financial mess. The US taxpayer helped Germany grow by subsidizing defense obligations while Germany paid almost nothing. Europe cannot continue to make believe, and avoid an eventual financial crisis. If Italy is allowed to continue to run up huge deficits, as they propose, then others will do the same. This will essentially bankrupt the ECB at some point. With Merkel going out, and the political vacuum is creating, and the UK going out of the EU, there is no good future for the EU over the net few years. Economic power has shifted to China and India, and the US is again ascendant. The UK will survive well outside of the EU. There is no way to know when the crisis really hits the EU, but it is coming in the next few years. If Congress does not act soon to cut entitlements, the US will not be far behind. This is why electing Democrats will be an economic disaster with their spend and tax policies. It will now have to be after 2020, if Trump is reelected, that we will hopefully see reform.
The Dems and press are going crazy over the new AG claiming he is going to destroy evidence, and hamper or fire Mueller. Both claims are absurd. He cannot just destroy documents. Everyone is watching, and he would go to jail if he did. Besides Rosenstein and the system have all the docs, so there is no way destruction could happen without everyone knowing. Second, it is reported the Mueller report is almost ready, so slowing him or firing him would be political suicide for Trump. Never happen now. He may constrain Mueller from continuing on after the report, and that would seem to be proper as Mueller was supposed to only look into Russia collusion, not Trump company and personal matters. He may appoint a new special counsel to examine the conspiracy to stop Trump, which is very apparent now. That, or assign it to a Federal prosecutor. And he likely will make the hidden docs available to Republicans in Congress that they have been requesting for almost a year. That is likely what the Dems are really worried about.
The Dems and the press forget that Holder was found in contempt for hiding documents on fast & furious, Lois Lerner hid information on how Obama used the IRS to go after conservative voters to suppress that vote, and how they jailed a video maker to cover up the truth about Benghazi. Now Nancy says Republicans need to be transparent—remember Nancy saying we have to pass ACA before we know what is in it. Or maybe we should forget the 40 FBI agents who were sent to Ferguson by Holder to get the cop, but instead proved he acted properly. That interference by Obama and Holder in a purely local matter triggered the racial divide we see today, and the claims of the left that all cops are racists who shoot blacks in the back, which I still hear today from my lefty friends. They do not want to hear about the hundreds of hero cops who get killed, like the one in the bar in CA, who rush in to save us.
If Nadler tries to go after Kavanaugh, it just motivates Republicans for 2020. If Maxine Waters tries to regulate the banks, it goes nowhere, but in the press. If Schiff tries to reopen the Russia probe after Mueller says there was no collusion, then he looks even more stupid, and the Dems will pay heavily for that. The public is fed up with the Russia garbage from Schiff. Trump will just go after Schiff for leaking classified information, which he did regularly. In the meantime, McConnell will be confirming judges and Trump will be doing a trade deal with Xi. The real battle will be when Ginsberg retires or dies. There is little chance she can continue for two more years. She has had pancreatic cancer, colon cancer and broken bones, and other serious health issues. Tough as she is, time and health are catching up. She will hang on as long as she is lucid to try to keep Trump from appointing her replacement. This is the real show to watch in 2019.
When I talk to die hard liberals, all they do is give me old talking points that are not even true. They ignore all of the violence perpetrated by the left against Republicans, and now against right wing reporters and talk show hosts. They just want to blame Trump and ignore all the violent rhetoric from Waters, Hollywood, and the press like Don Lemon and Maddow and others who espouse far left attacks on Trump and Republicans in very derogatory, or even clearly threatening language. I suggest to my liberal friends you try to get facts before mouthing off. I note that the left are often hypocrites when it comes to women. This week Vogue ran a piece saying any women who vote Republican are doing so against their own interest. In short, they are saying women should not think for themselves, but Trump is a misogynist. Yet they elect Ellison, an abuser to be AG. Democrats ignore the fact that economic and military strength is key to US economic success, and they are more interested in more entitlements, sanctuary cities, open borders, and if Trump paid some bimbo to be quiet. Obama nearly destroyed the world with his policies and withdrawal from leadership in the world, and we have a short period now to fix it. Instead the Dems want to try to impeach Kavanaugh and Trump.
Now Macron says he needs a European army to protect against the US. Good -let them form their own army and pay, and we can go home. What absurd nonsense. The EU could not defend against anyone without us, and they never could in the past two World Wars. Macron is a kid playing at big boy games.
